A RESOLUTION
1- 1 Compensating A. K. Pearson; and for other purposes.
1- 2 WHEREAS, on December 19, 1997, A.K. Pearson was driving east
1- 3 on Memorial Drive in Fulton County, Georgia, in fair weather
1- 4 and light traffic conditions traveling at a speed of
1- 5 approximately 30-35 mph; and
1- 6 WHEREAS, as he passed through the intersection of Memorial
1- 7 Drive and Glenwood-Memorial Connector, his automobile struck
1- 8 or collided with an unseen obstruction in the roadway; and
1- 9 WHEREAS, upon immediately returning to the scene of the
1-10 apparent collision, Mr. Pearson observed no foreign object
1-11 in the road but did observe two storm drain grates which
1-12 were set into the road at a level well below the level of
1-13 the pavement causing the pavement to be considerably uneven;
1-14 and
1-15 WHEREAS, it was the uneven position of the storm drain
1-16 grates placed in that location by the Department of
1-17 Transportation that caused Mr. Pearson's accident; and
1-18 WHEREAS, the accident caused damage to Mr. Pearson's
1-19 automobile in the nature of right front tire misalignment, a
1-20 bent tie rod, and a bent right front frame; and
1-21 WHEREAS, total repair costs paid by Mr. Pearson for damage
1-22 to the automobile totaled $1,130.95; and
1-23 WHEREAS, the loss occurred through no fault or negligence on
1-24 the part of A. K. Pearson, and it is only fitting and proper
1-25 that he be compensated for his loss.
1-26 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF
1-27 GEORGIA that the Department of Revenue is authorized and
1-28 directed to pay the sum of $1,130.95 to A. K. Pearson as
1-29 compensation as provided above. Said sum shall be paid from
1-30 funds appropriated to or available to said department and
1-31 shall be in full and complete satisfaction of all claims
1-32 against the state arising out of said occurrence.
