A RESOLUTION
1- 1 Compensating Mr. Robert C. Stripling; and for other
1- 2 purposes.
1- 3 WHEREAS, the Georgia Civil War Commission was by a
1- 4 resolution approved April 28, 1993 (Ga. L. 1993, p. 1952)
1- 5 established as an entity of state government and attached
1- 6 for administrative purposes to the Department of Natural
1- 7 Resources; and
1- 8 WHEREAS, on or about July 24, 1996, an agent of the
1- 9 commission directed a private contractor in carrying out the
1-10 clearing of certain property subject to the control of the
1-11 commission in Twiggs County; and
1-12 WHEREAS, the private contractor without authority cleared
1-13 timber from approximately three acres of adjoining property
1-14 belonging to Mr. Robert C. Stripling; and in the process the
1-15 contractor also destroyed approximately 800 feet of fence
1-16 belonging to Mr. Stripling which separated the two tracts of
1-17 land; and
1-18 WHEREAS, Mr. Stripling promptly reported the damage to his
1-19 property to the Twiggs County Sheriff's Office, and criminal
1-20 proceedings were instituted by the State against the private
1-21 contractor; and
1-22 WHEREAS, an order of nolle prosequi was entered in these
1-23 criminal proceedings on or about July 15, 1997, based on the
1-24 State's determination at such time that the private
1-25 contractor's actions had been carried out because of
1-26 express, but incorrect and wrongful, instructions from the
1-27 agent of the Civil War Commission to the private contractor;
1-28 and
1-29 WHEREAS, as a result Mr. Stripling has suffered unreimbursed
1-30 property damages totaling $5,015.00 through the fault of the
1-31 agent of the commission; and
1-32 WHEREAS, this incident and loss occurred through no fault or
1-33 negligence on the part of Mr. Stripling, and it is only
1-34 fitting and proper that he be compensated for his loss.

2- 1 NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF
2- 2 GEORGIA that the Department of Natural Resources is
2- 3 authorized and directed to pay the sum of $5,015.00 to Mr.
2- 4 Robert C. Stripling as compensation as provided above. Said
2- 5 sum shall be paid from funds appropriated to or available to
2- 6 said Department of Natural Resources and shall be in full
2- 7 and complete satisfaction of all claims against the state
2- 8 arising out of said occurrence.
