A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 60 of Title 36 of the Official Code of
1- 2 Georgia Annotated, relating to general provisions applicable
1- 3 to counties and municipal corporations, so as to provide an
1- 4 exception for certain volunteer firefighters to serve as a
1- 5 member of the governing authority of a county or municipal
1- 6 corporation; to provide for statutory construction; to
1- 7 repeal conflicting laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Chapter 60 of Title 36 of the Official Code of Georgia
1-11 Annotated, relating to general provisions applicable to
1-12 counties and municipal corporations, is amended by adding at
1-13 the end a new Code section to read as follows:
1-14 "36-60-22.
1-15 (a) As used in this Code section, the term 'volunteer
1-16 firefighter' means a person who is a volunteer
1-17 firefighter, as defined in Code Section 47-7-1, relating
1-18 to definitions regarding the Georgia Firefighters' Pension
1-19 Fund, and who receives no compensation for services as a
1-20 volunteer firefighter other than:
1-21 (1) Actual expenses incurred;
1-22 (2) A per diem for services;
1-23 (3) Contributions to the Georgia Firefighters' Pension
1-24 fund;
1-25 (4) Workers' compensation coverage under Chapter 9 of
1-26 Title 34; or
1-27 (5) Any combination of items specified in paragraphs (1)
1-28 through (4) of this subsection.
1-29 (b) Notwithstanding the provisions of Code Section
1-30 36-30-4, 45-2-2, or any other provision of law to the
1-31 contrary, a volunteer firefighter for a county or

2- 1 municipal corporation shall be eligible to serve as a
2- 2 member of the governing authority of that county or
2- 3 municipal corporation.
2- 4 (c) Nothing in this Code section shall require a county or
2- 5 municipal governing authority to make any of the payments
2- 6 or offer the benefits to volunteer firefighters specified
2- 7 in subsection (a) of this Code section."
2- 8 SECTION 2.
2- 9 All laws and parts of laws in conflict with this Act are
2-10 repealed.
