                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 2 of Title 21 of the Official Code of 
  1- 2  Georgia Annotated, the "Georgia Election Code," so as to 
  1- 3  change the dates for the general primary and nonpartisan 
  1- 4  primary; to delete certain provisions relating to primaries 
  1- 5  held in the same week as national political conventions; to 
  1- 6  provide for an effective date; to provide for related 
  1- 7  matters; to repeal conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Chapter 2 of Title 21 of the Official Code of Georgia 
  1-11  Annotated, the "Georgia Election Code," is amended by 
  1-12  striking in its entirety Code Section 21-2-150, relating to 
  1-13  the date of the general primary and the date of the 
  1-14  nonpartisan primary, and inserting in lieu thereof a new 
  1-15  Code Section 21-2-150 to read as follows: 
 
  1-16    "21-2-150. 
 
  1-17    (a) Whenever any political party holds a primary to 
  1-18    nominate candidates for public offices to be filled in the 
  1-19    ensuing November election, such primary shall be held on 
  1-20    the third Tuesday in July in each even-numbered year, or, 
  1-21    in the case of municipalities, on the third Tuesday in 
  1-22    July in each odd-numbered year, except as provided in 
  1-23    subsection (c) of this Code section second Tuesday 
  1-24    following the first Monday in September. 
 
  1-25    (b) Whenever any nonpartisan primary is held to nominate 
  1-26    candidates for the office of judge of the state court, 
  1-27    judge of the superior court, Judge of the Court of 
  1-28    Appeals, or Justice of the Supreme Court to be filled in 
  1-29    the ensuing November election, such primary shall be held 
  1-30    jointly with the political primaries on the third Tuesday 
  1-31    in July second Tuesday following the first Monday in 
  1-32    September in each even-numbered year, except as provided 
  1-33    in subsection (c) of this Code section.

  2- 1    (c) Whenever the primary occurs during the same week of 
  2- 2    the national convention of either the political party 
  2- 3    whose candidates received the highest number of votes or 
  2- 4    the political party whose candidates received the next 
  2- 5    highest number of votes in the last presidential election, 
  2- 6    the general primary shall be conducted on the second 
  2- 7    Tuesday in July of such year. This subsection shall not 
  2- 8    apply unless the date of the convention of the political 
  2- 9    party is announced by the political party prior to April 1 
  2-10    of the year in which the general primary is conducted." 
 
  2-11                           SECTION 2. 
 
  2-12  This Act shall become effective on January 1, 2000. 
 
  2-13                           SECTION 3. 
 
  2-14  All laws and parts of laws in conflict with this Act are
