A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 43-15-6 of the Official Code of
1- 2 Georgia Annotated, relating to the general powers of the
1- 3 State Board of Registration for Professional Engineers and
1- 4 Land Surveyors, so as to provide for an exemption for
1- 5 certain eligible engineers from continuing education
1- 6 requirements; to provide for related matters; to repeal
1- 7 conflicting laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Code Section 43-15-6 of the Official Code of Georgia
1-11 Annotated, relating to the general powers of the State Board
1-12 of Registration for Professional Engineers and Land
1-13 Surveyors, is amended by striking subsection (b) and
1-14 inserting in lieu thereof a new subsection to read as
1-15 follows:
1-16 "(b) In addition to other powers conferred upon the board
1-17 under this chapter, the board shall through rules and
1-18 regulations require each person seeking renewal of a
1-19 certificate of registration as a professional engineer or
1-20 a land surveyor to complete board approved continuing
1-21 education of not more than 30 hours biennially for
1-22 professional engineers and not more than 15 hours
1-23 biennially for land surveyors. The board shall be
1-24 authorized to approve courses offered by institutions of
1-25 higher learning or offered by other institutions or
1-26 organizations. The board shall randomly audit some
1-27 applications for renewal of a certificate of registration
1-28 to enforce compliance with this subsection. The
1-29 continuing education requirements adopted by the board
1-30 shall recognize the continuing education requirements
1-31 imposed by other states to the extent that such continuing
1-32 education courses meet the requirements imposed by the
1-33 board. The board shall be authorized to waive the
1-34 continuing education requirements in cases of hardship,
1-35 disability, or illness or under such other circumstances

2- 1 as the board deems appropriate. The board shall waive the
2- 2 continuing education requirement for individuals over the
2- 3 age of 65 who have retired from active practice and who
2- 4 apply for an inactive license and for individuals over the
2- 5 age of 70 who are engaged in the active practice of their
2- 6 profession who have had a valid active license for the
2- 7 previous ten consecutive years. The requirement for
2- 8 continuing education shall apply to each licensing renewal
2- 9 cycle which begins after the 1996 renewal cycle."
2-10 SECTION 2.
2-11 All laws and parts of laws in conflict with this Act are
2-12 repealed.
