A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 12 of the Official Code of
1- 2 Georgia Annotated, relating to the Department of Natural
1- 3 Resources, so as to authorize local governments to adopt and
1- 4 enforce watershed protection plans applicable to certain
1- 5 streams and reservoirs which are used for the public water
1- 6 supply of such local governments; to provide for an
1- 7 effective date; to repeal conflicting laws; and for other
1- 8 purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1-10 SECTION 1.
1-11 Chapter 2 of Title 12 of the Official Code of Georgia
1-12 Annotated, relating to the Department of Natural Resources,
1-13 is amended by striking subsection (d) of Code Section
1-14 12-2-8, relating to watershed protection standards, and
1-15 inserting in lieu thereof a new subsection (d) to read as
1-16 follows:
1-17 "(d) The minimum standards and procedures for watershed
1-18 protection referred to in subsection (b) of this Code
1-19 section shall specifically include, but shall not be
1-20 limited to, buffer areas along streams and reservoirs,
1-21 land development densities, and land use activities. The
1-22 department may adopt differing minimum standards and
1-23 procedures of watershed protection based on the size of
1-24 the watershed, the size or flow volume of the stream or
1-25 reservoir, and whether or not the actual use of the
1-26 municipal water supply is existing or proposed. A local
1-27 government may adopt and enforce watershed protection
1-28 plans applicable to streams and reservoirs within or
1-29 without the territorial limits of such local government
1-30 which are to be used for the public water supply of such
1-31 local government, provided that the streams and reservoirs
1-32 to which such watershed protection plans are applicable
1-33 are within the same region as the local government, as
1-34 that term is defined in paragraph (19) of subsection (a)
1-35 of Code Section 50-8-2."

2- 1 SECTION 2.
2- 2 This Act shall become effective upon its approval by the
2- 3 Governor or upon its becoming law without such approval.
2- 4 SECTION 3.
2- 5 All laws and parts of laws in conflict with this Act are
2- 6 repealed.
