A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 9 of Title 12 of the Official Code of
1- 2 Georgia Annotated, relating to prevention and control of air
1- 3 pollution, so as to provide for additional requirements with
1- 4 respect to the prescribing of certain rules and regulations
1- 5 by the Board of Natural Resources; to provide an effective
1- 6 date; to repeal conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 8 SECTION 1.
1- 9 Chapter 9 of Title 12 of the Official Code of Georgia
1-10 Annotated, relating to prevention and control of air
1-11 pollution, is amended by adding a new article at the end
1-12 thereof, to be designated Article 3, to read as follows:
1-13 12-9-70.
1-14 As used in this article, the term 'board' means the Board
1-15 of Natural Resources of the State of Georgia.
1-16 12-9-71.
1-17 Notwithstanding any other provision of law to the
1-18 contrary, in no event shall the board be authorized to
1-19 prescribe any rule and regulation under Article 1 or 2 of
1-20 this chapter which have a cost in excess of $2,000.00 per
1-21 ton per year of nitrogen oxide compounds unless such rule
1-22 and regulation has:
1-23 (1) Had a complete cost benefit analysis conducted with
1-24 respect thereto; and
1-25 (2) Been approved by a joint resolution of both houses
1-26 of the General Assembly."
1-27 SECTION 2.
1-28 This Act shall become effective upon its approval by the
1-29 Governor or upon its becoming law without such approval.

2- 2 All laws and parts of laws in conflict with this Act are
2- 3 repealed.
