A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-6-91 of the Official Code of
1- 2 Georgia Annotated, relating to the right of way in
1- 3 crosswalks, so as to require the driver of a vehicle to stop
1- 4 and remain stopped to allow a pedestrian to cross the
1- 5 roadway within a painted crosswalk when the pedestrian has
1- 6 stepped onto the roadway on either side of the roadway; to
1- 7 repeal conflicting laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 9 SECTION 1.
1-10 Code Section 40-6-91 of the Official Code of Georgia
1-11 Annotated, relating to the right of way in crosswalks, is
1-12 amended by striking subsection (a) of said Code section and
1-13 inserting in lieu thereof a new subsection (a) to read as
1-14 follows:
1-15 "(a) The driver of a vehicle shall stop and remain stopped
1-16 to allow a pedestrian to cross the roadway within a
1-17 painted crosswalk when the pedestrian is upon the half of
1-18 the roadway upon which the vehicle is traveling, or when
1-19 the pedestrian is approaching and is within one lane of
1-20 the half of the roadway on which the vehicle is traveling
1-21 or onto which it is turning. For the purposes of this
1-22 subsection, 'half of the roadway' means all traffic lanes
1-23 carrying traffic in one direction of travel has stepped
1-24 onto the roadway on either side of the roadway."
1-25 SECTION 2.
1-26 All laws and parts of laws in conflict with this Act are
1-27 repealed.
