                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Article 6 of Chapter 2 of Title 20 of the Official 
  1- 2  Code of Georgia Annotated, the "Quality Basic Education 
  1- 3  Act," so as to require local boards of education to adopt 
  1- 4  policies defining the adequate academic performance of 
  1- 5  students and to prohibit the promotion of students in 
  1- 6  violation of such policies; to require that students in the 
  1- 7  third grade achieve a satisfactory score on a reading test 
  1- 8  before promotion to the next grade level; to authorize the 
  1- 9  State Board of Education to promulgate certain regulations; 
  1-10  to provide for the application of these requirements to 
  1-11  students in special education programs; to provide for an 
  1-12  effective date; to repeal conflicting laws; and for other 
  1-13  purposes. 
 
  1-14       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-15                           SECTION 1. 
 
  1-16  Article 6 of Chapter 2 of Title 20 of the Official Code of 
  1-17  Georgia Annotated, the "Quality Basic Education Act," is 
  1-18  amended in Part 2, relating to competencies and core 
  1-19  curriculum, by adding at the end thereof a new Code section, 
  1-20  to be designated as Code Section 20-2-146, to read as 
  1-21  follows: 
 
  1-22    "20-2-146. 
 
  1-23    (a) Local boards of education shall adopt policies 
  1-24    defining the adequate academic performance of students, 
  1-25    and no student shall be promoted from one grade to another 
  1-26    in violation of that policy. 
 
  1-27    (b) The restriction on promotion in this Code section 
  1-28    shall not apply to any disabled student who is lawfully 
  1-29    assigned to a special education program unless such 
  1-30    restriction is consistent with the student's 
  1-31    Individualized Education Program."

  2- 1                           SECTION 2. 
 
  2- 2  Said article is further amended in Code Section 20-2-281, 
  2- 3  relating to assessment of the effectiveness of educational 
  2- 4  programs, by adding at the end thereof a new subsection, to 
  2- 5  be designated as subsection (f), to read as follows: 
 
  2- 6    "(f) No student shall be promoted from grade three unless 
  2- 7    the student has achieved a satisfactory score on a 
  2- 8    nationally norm-referenced instrument in reading.  The 
  2- 9    State Board of Education is authorized and directed to 
  2-10    adopt regulations to implement this subsection.  Said 
  2-11    regulations shall specify the particular test to be 
  2-12    administered and define the satisfactory score on such 
  2-13    test.  Said regulations shall further provide that any 
  2-14    disabled child, as defined by the provisions of this 
  2-15    article, shall be afforded opportunities to take any test 
  2-16    adopted by the state board to implement this subsection. 
  2-17    Said regulations shall further provide for appropriate 
  2-18    accommodations in the administration of such tests.  The 
  2-19    requirements of this subsection shall not apply to any 
  2-20    disabled student who is lawfully assigned to a special 
  2-21    education program unless such requirements are consistent 
  2-22    with the student's Individualized Education Program." 
 
  2-23                           SECTION 3. 
 
  2-24  This Act shall become effective on July 1, 1999. 
 
  2-25                           SECTION 4. 
 
  2-26  All laws and parts of laws in conflict with this Act are
