                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Code Section 42-2-8 of the Official Code of Georgia 
  1- 2  Annotated, relating to the additional duties of the 
  1- 3  commissioner of corrections, so as to provide that the Board 
  1- 4  of Corrections is authorized to accept on behalf of and for 
  1- 5  the benefit of the Department of Corrections gifts, grants, 
  1- 6  donations, property, and services; to provide an effective 
  1- 7  date; to repeal conflicting laws; and for other purposes. 
 
  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1- 9                           SECTION 1. 
 
  1-10  Code Section 42-2-8 of the Official Code of Georgia 
  1-11  Annotated, relating to the additional duties of the 
  1-12  commissioner of corrections, is amended by striking said 
  1-13  Code section and inserting in lieu thereof the following: 
 
  1-14    "42-2-8. 
 
  1-15    The commissioner shall direct and supervise all the 
  1-16    administrative activities of the board and shall attend 
  1-17    all meetings of the board. The commissioner shall also 
  1-18    make, publish, and furnish to the General Assembly and to 
  1-19    the Governor annual reports regarding the work of the 
  1-20    board, along with such special reports as he or she may 
  1-21    consider helpful in the administration of the penal system 
  1-22    or as may be directed by the board.  The commissioner 
  1-23    shall perform such other duties and functions as are 
  1-24    necessary or desirable to carry out the intent of this 
  1-25    chapter and which he or she may be directed to perform by 
  1-26    the board.  The commissioner or the commissioner's 
  1-27    designee shall be authorized to make and execute contracts 
  1-28    and all other instruments necessary or convenient for the 
  1-29    acquisition of professional and personal employment 
  1-30    services and for the leasing of real property.  Subject to 
  1-31    legislative appropriations, the commissioner shall also be 
  1-32    authorized to make and execute any contract for the land 
  1-33    acquisition, design, construction, operation, maintenance, 
  1-34    use, lease, or management of a state correctional

  2- 1    institution or for any services pertaining to the custody, 
  2- 2    care, and control of inmates or other functions as are 
  2- 3    related to the discharge of these responsibilities and to 
  2- 4    designate any person or organization with whom the 
  2- 5    commissioner contracts as a law enforcement unit under 
  2- 6    paragraph (7) of Code Section 35-8-2.  The Board of 
  2- 7    Corrections shall be authorized to accept on behalf of and 
  2- 8    solely for the use and benefit of the Department of 
  2- 9    Corrections gifts; grants; donations; bequests; property, 
  2-10    real, personal, and mixed; and services." 
 
  2-11                           SECTION 2. 
 
  2-12  This Act shall become effective upon its approval by the 
  2-13  Governor or upon its becoming law without such approval. 
 
  2-14                           SECTION 3. 
 
  2-15  All laws and parts of laws in conflict with this Act are
