                        A BILL TO BE ENTITLED 
                               AN ACT 
 
 
  1- 1  To amend Chapter 7 of Title 34  of the Official Code of 
  1- 2  Georgia Annotated, relating to general provisions relative 
  1- 3  to employer and employee, so as to remove a requirement for 
  1- 4  the employee's consent to payment by credit transfer; to 
  1- 5  provide an exception for any employee who does not have an 
  1- 6  account with a bank, trust company, or financial 
  1- 7  institution; to repeal conflicting laws; and for other 
  1- 8  purposes. 
 
  1- 9       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: 
 
  1-10                           SECTION 1. 
 
  1-11  Chapter 7 of Title 34  of the Official Code of Georgia 
  1-12  Annotated, relating to general provisions relative to 
  1-13  employer and employee, is amended by striking in its 
  1-14  entirety Code Section 34-7-2, relating to methods for paying 
  1-15  wages and payment dates, and inserting in its place the 
  1-16  following: 
 
  1-17    "34-7-2. 
 
  1-18    Every person, firm, or corporation, including steam and 
  1-19    electric railroads, but not including farming, sawmill, 
  1-20    and turpentine industries, employing skilled or unskilled 
  1-21    wageworkers in manual, mechanical, or clerical labor, 
  1-22    including all employees except officials, superintendents, 
  1-23    or other heads or subheads of department who may be 
  1-24    employed by the month or year at stipulated salaries, 
  1-25    shall make wage and salary payments to such employees or 
  1-26    to their authorized representatives (1) by lawful money of 
  1-27    the United States, (2) by check, or (3) with the consent 
  1-28    of the employee, by authorization of credit transfer to 
  1-29    his or her account with a bank, trust company, or other 
  1-30    financial institution authorized by the United States or 
  1-31    one of the several states to receive deposits in the 
  1-32    United States; provided, however, that an employer shall 
  1-33    make wage and salary payment to any employee who does not 
  1-34    have an account with a bank, trust company, or other

  2- 1    financial institution authorized to receive deposits, by 
  2- 2    lawful money of the United States  or by check. Such 
  2- 3    payments shall be made on such dates during the month as 
  2- 4    may be decided upon by such person, firm, or corporation; 
  2- 5    provided, however, that the dates so selected shall be 
  2- 6    such that the month will be divided into at least two 
  2- 7    equal periods; and provided, further, that the payments 
  2- 8    made on each such date shall in every case correspond to 
  2- 9    the full net amount of wages or earnings due the employees 
  2-10    for the period for which the payment is made." 
 
  2-11                           SECTION 2. 
 
  2-12  All laws and parts of laws in conflict with this Act are
