A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Part 3 of Article 7 of Chapter 3 of Title 12 of the
1- 2 Official Code of Georgia Annotated, relating to the Lake
1- 3 Lanier Islands Development Authority, so as to expand the
1- 4 purposes for which the authority may expend income and
1- 5 revenue; to repeal conflicting laws; and for other purposes.
1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
1- 7 SECTION 1.
1- 8 Part 3 of Article 7 of Chapter 3 of Title 12 of the Official
1- 9 Code of Georgia Annotated, relating to the Lake Lanier
1-10 Islands Development Authority, is amended by striking in its
1-11 entirety Code Section 12-3-318, relating to the purposes for
1-12 which income, gifts, grants, appropriations, bonds, or loans
1-13 available to such authority may be spent, and inserting in
1-14 lieu thereof the following:
1-15 "12-3-318.
1-16 (a) All income, revenues, gifts, grants, appropriations,
1-17 bond or loan proceeds, and rights and privileges of value
1-18 of every nature accruing to the authority shall be used:
1-19 (1) Primarily for the sole purpose of beautifying,
1-20 improving, developing, maintaining, administering,
1-21 managing, and promoting the islands in Lake Lanier; and
1-22 (2) Secondarily for the purpose of beautifying,
1-23 improving, developing, maintaining, administering,
1-24 managing, and promoting any other real property which
1-25 is:
1-26 (A) Under the management and control of the department
1-27 or the North Georgia Mountains Authority whether held
1-28 in fee simple or under or through a contract, license,
1-29 lease, or other similar agreement with an agency of
1-30 the federal government; and

2- 1 (B) Adjacent to any lake or reservoir in this state
2- 2 that is under the management and control of the United
2- 3 States Army Corps of Engineers.
2- 4 (b) The authority shall accomplish the purposes provided
2- 5 in subsection (a) of this Code section at the lowest rates
2- 6 reasonable and possible for the benefit of the people of
2- 7 the State of Georgia for recreational purposes.
2- 8 (c) Prior to authorizing the expenditure of funds for any
2- 9 of the secondary purposes set forth in subsection (a) of
2-10 this Code section, the authority shall consult with the
2-11 Senate Economic Development, Tourism, and Cultural Affairs
2-12 Committee, the House Committee on Game, Fish, and Parks,
2-13 and the Governor for the purpose of assistance in
2-14 establishing the priority of needs among the real
2-15 properties eligible to receive the benefit of such
2-16 expenditure."
2-17 SECTION 2.
2-18 All laws and parts of laws in conflict with this Act are
2-19 repealed.
