      SENATE RESOLUTION 35 
 
      By:  Senators Madden of the 47th, Streat of the 19th, 
           Gillis of the 20th and Ragan of the 11th 
 
                             A RESOLUTION 
 
  1- 1  Creating the  Senate Indigent Care Trust Fund Study 
  1- 2  Committee; and for other purposes. 
 
  1- 3  WHEREAS, the Indigent Care Trust Fund was statutorily 
  1- 4  established  in 1990 to utilize contributions of state and 
  1- 5  local health care funds to obtain additional federal funds 
  1- 6  to finance health care for indigent residents of this state; 
  1- 7  and 
 
  1- 8  WHEREAS, the federal law relating to matching federal 
  1- 9  funding has subsequently changed and will result in a 
  1-10  reduction in federal moneys to the indigent care trust fund; 
  1-11  and 
 
  1-12  WHEREAS, the fund has complex formulas for calculating its 
  1-13  distributions and an examination needs to be made to ensure 
  1-14  the formula distributions are correct and made for the 
  1-15  limited purposes authorized for fund distributions; and 
 
  1-16  WHEREAS, recent distributions have been delayed due to 
  1-17  misunderstandings in how the moneys are to be used; and 
 
  1-18  WHEREAS, rural hospitals depend heavily upon the fund for 
  1-19  their financial survival; and 
 
  1-20  WHEREAS, some rural hospitals cannot receive distributions 
  1-21  from the fund because of formula problems. 
 
  1-22  NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is 
  1-23  created the Senate Indigent Care Trust Fund Study Committee 
  1-24  to be composed of five members of the Senate to be appointed 
  1-25  by the President of the Senate. The President of the Senate 
  1-26  shall designate a member of the committee as chairperson of 
  1-27  the committee.  The chairperson shall call all meetings of 
  1-28  the committee. 
 
  1-29  BE IT FURTHER RESOLVED that the committee shall undertake a 
  1-30  study of the conditions, needs, issues, and problems 
  1-31  mentioned above or related thereto and recommend any actions 
  1-32  or legislation which the committee deems necessary or 
  1-33  appropriate.  The committee may conduct such meetings at 
  1-34  such places and at such times as it may deem necessary or 
  1-35  convenient to enable it to exercise fully and effectively

  2- 1  its powers, perform its duties, and accomplish the 
  2- 2  objectives and purposes of this resolution.  The members of 
  2- 3  the committee shall receive the allowances authorized for 
  2- 4  legislative members of interim legislative committees but 
  2- 5  shall receive the same for not more than five days unless 
  2- 6  additional days are authorized.  The funds necessary to 
  2- 7  carry out the provisions of this resolution shall come from 
  2- 8  the funds appropriated to the Senate.  In the event the 
  2- 9  committee makes a report of its findings and 
  2-10  recommendations, with suggestions for proposed legislation, 
  2-11  if any, such report shall be made on or before December 15, 
  2-12  1999.  The committee shall stand abolished on December 15,
