A RESOLUTION
1- 1 Authorizing the conveyance of certain state owned real
1- 2 property located in Baldwin County, Georgia; authorizing the
1- 3 conveyance of certain state owned real property located in
1- 4 Bartow County, Georgia; authorizing the conveyance of
1- 5 certain state owned real property located in DeKalb County,
1- 6 Georgia; authorizing the conveyance of certain state owned
1- 7 real property in Elbert County, Georgia; authorizing the
1- 8 conveyance of certain state owned real property located in
1- 9 Floyd County, Georgia; authorizing the conveyance of certain
1-10 state owned real property located in Glascock County,
1-11 Georgia; to repeal conflicting laws; and for other purposes.
1-12 WHEREAS:
1-13 (1) The State of Georgia is the owner of a certain
1-14 parcel of real property located in Baldwin County,
1-15 Georgia;
1-16 (2) Said real property is all that tract or parcel of
1-17 land lying and being in the 319th Georgia Militia
1-18 District of Baldwin County and containing approximately
1-19 8 acres fronting on the east side of State Highway 22
1-20 and being shown as parcel "B" on a drawing dated January
1-21 6, 1998, and on file in the offices of the State
1-22 Properties Commission, and may be more particularly
1-23 described on a plat of survey prepared by a Georgia
1-24 registered land surveyor and presented to the State
1-25 Properties Commission for approval;
1-26 (3) Said property is under the custody of the Georgia
1-27 Department of Juvenile Justice;
1-28 (4) The above-described property is separated from the
1-29 main campus of the Baldwin County Youth Development
1-30 Campus by State Highway 22;
1-31 (5) The above-described property is not being utilized
1-32 and the Department of Juvenile Justice has determined it
1-33 will have no future need for the property; and
1-34 WHEREAS:

2- 1 (1) The State of Georgia is the owner of a certain
2- 2 parcel of real property located in Bartow County,
2- 3 Georgia;
2- 4 (2) Said real property is all that tract or parcel of
2- 5 land lying and being in Land Lot 604 of the 4th
2- 6 District, 3rd Section of Bartow County and containing
2- 7 approximately 1.38 acres as shown on a plat of survey
2- 8 prepared by William C. Smith, Georgia Registered Land
2- 9 Surveyor #1803, dated September 22, 1993, and on file in
2-10 the offices of the State Properties Commission, and may
2-11 be more particularly described on a plat of survey
2-12 prepared by a Georgia registered land surveyor and
2-13 presented to the State Properties Commission for
2-14 approval;
2-15 (3) Said property is under the custody of the State
2-16 Properties Commission and is a portion of the Western
2-17 and Atlantic Railroad right of way which is leased to
2-18 CSX Transportation;
2-19 (4) The above-described property is currently subleased
2-20 by CSX Transportation to the Baroid Division of Dresser
2-21 Industries Inc.;
2-22 (5) The Baroid Division of Dresser Industries Inc. is
2-23 desirous of acquiring the above-described state owned
2-24 property in order to make certain capital improvements
2-25 to their facilities; and
2-26 WHEREAS:
2-27 (1) The State of Georgia is the owner of a certain
2-28 parcel of real property located in DeKalb County,
2-29 Georgia;
2-30 (2) Said real property is all that tract or parcel of
2-31 land lying and being in Land Lot 10 of the 18th
2-32 District of DeKalb County and containing approximately
2-33 2.9 acres as shown on a plat of survey prepared by James
2-34 Robert Cheatham, Georgia Registered Land Surveyor, dated
2-35 July 1968, and on file in the offices of the State
2-36 Properties Commission, and may be more particularly
2-37 described on a plat of survey prepared by a Georgia
2-38 registered land surveyor and presented to the State
2-39 Properties Commission for approval;
2-40 (3) Said unimproved property is under the custody of the
2-41 Department of Education and is no longer needed for the
2-42 purpose for which it was originally acquired;

3- 1 (4) The DeKalb County Board of Education conveyed the
3- 2 above-described property to the state in April of 1972,
3- 3 for the consideration of $1.00;
3- 4 (5) The DeKalb County Board of Education is desirous of
3- 5 acquiring the above-described state owned real property
3- 6 for a public purpose; and
3- 7 WHEREAS:
3- 8 (1) The State of Georgia is the owner of a certain
3- 9 parcel of real property located in Elbert County,
3-10 Georgia;
3-11 (2) Said real property is all that tract or parcel of
3-12 land lying and being in the 189th Georgia Militia
3-13 District of Elbert County within the city limits of the
3-14 City of Elberton and containing approximately 6.06 acres
3-15 as shown on a drawing prepared by the Georgia National
3-16 Guard which depicts the exchange of two parcels with the
3-17 City of Elberton, and on file in the offices of the
3-18 State Properties Commission, and may be more
3-19 particularly described on a plat of survey prepared by a
3-20 Georgia registered land surveyor and presented to the
3-21 State Properties Commission for approval;
3-22 (3) The Department of Defense intends to relocate its
3-23 National Guard activities in Elbert County to a new
3-24 location and once the National Guard has vacated the
3-25 above-described property, the Department of Defense
3-26 intends to declare the property surplus to its needs;
3-27 (4) The City of Elberton, Elbert County, conveyed the
3-28 above-described property to the state on November 16,
3-29 1954, for the consideration of $10.00;
3-30 (5) The City of Elberton, Elbert County, is desirous of
3-31 acquiring the above-described state owned real property
3-32 for a public purpose; and
3-33 WHEREAS:
3-34 (1) The State of Georgia is the owner of a certain
3-35 parcel of real property located in Floyd County,
3-36 Georgia;
3-37 (2) Said real property is all that tract or parcel of
3-38 land lying and being in Land Lot 232 of the 23rd
3-39 District, 3rd Section of Floyd County containing
3-40 approximately 2.07 acres as shown on a drawing prepared
3-41 by the State Properties Commission which depicts the two

4- 1 parcels which comprise the subject property, and on file
4- 2 in the offices of the State Properties Commission, and
4- 3 may be more particularly described on a plat of survey
4- 4 prepared by a Georgia registered land surveyor and
4- 5 presented to the State Properties Commission for
4- 6 approval;
4- 7 (3) The Georgia Forestry Commission intends to relocate
4- 8 its activities in Floyd County to a new location and
4- 9 once the above-described property is vacated, the
4-10 Georgia Forestry Commission intends to declare the
4-11 property surplus to its needs;
4-12 (4) Floyd County has agreed to convey to the state, for
4-13 the consideration of $1.00, a new site to house future
4-14 activities of the Georgia Forestry Commission;
4-15 (5) Floyd County conveyed a portion of the
4-16 above-described real property to the state on November
4-17 1, 1960, and the remainder of the site on May 6, 1993,
4-18 each for the consideration of $1.00;
4-19 (6) Floyd County is desirous of acquiring the
4-20 above-described state owned real property for a public
4-21 purpose; and
4-22 WHEREAS:
4-23 (1) The State of Georgia is the owner of a certain
4-24 parcel of real property located in Glascock County,
4-25 Georgia;
4-26 (2) Said real property is all those tracts or parcels of
4-27 land lying and being in the 1167th Georgia Militia
4-28 District of Glascock County and containing a total of
4-29 approximately 0.98 of one acre as shown on a plat of
4-30 survey prepared by Joe Dean Usry, Georgia Registered
4-31 Land Surveyor No. 1899, dated October 17, 1977, and
4-32 revised June 10, 1978, and on a drawing recorded May 27,
4-33 1965, and being on file in the offices of the State
4-34 Properties Commission, and may be more particularly
4-35 described on a plat of survey prepared by a Georgia
4-36 registered land surveyor and presented to the State
4-37 Properties Commission for approval;
4-38 (3) The Georgia Forestry Commission intends to relocate
4-39 its activities in Glascock County to a new location and
4-40 once the Georgia Forestry Commission has vacated the
4-41 above-described property, the commission intends to
4-42 declare the property surplus to its needs;

5- 1 (4) Glascock County conveyed a portion of the
5- 2 above-described property to the state on May 26, 1965
5- 3 and the remainder of the site on April 3, 1979, each for
5- 4 the consideration of $10.00;
5- 5 (5) Glascock County is desirous of acquiring the
5- 6 above-described state owned real property for a public
5- 7 purpose.
5- 8 NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL
5- 9 ASSEMBLY OF GEORGIA:
5-10 SECTION 1.
5-11 That the State of Georgia is the owner of the
5-12 above-described real property located in Baldwin County and
5-13 that in all matters relating to the conveyance of the real
5-14 property the State of Georgia is acting by and through its
5-15 State Properties Commission.
5-16 SECTION 2.
5-17 That all or a portion of the above-described real property
5-18 may be sold by competitive bid for a consideration of the
5-19 fair market value of such property as determined to be in
5-20 the best interest of the State of Georgia by the State
5-21 Properties Commission or may be exchanged for property or
5-22 properties of an equal value as determined to be in the best
5-23 interest of the State of Georgia as determined by the State
5-24 Properties Commission; provided, however, that all or a
5-25 portion of the above-described real property may be sold to
5-26 a city, county, school board, or other local public entity,
5-27 which shall include development authorities, for not less
5-28 than the fair market value without the necessity of
5-29 competitive bid, and such further consideration and
5-30 provisions as the State Properties Commission shall in its
5-31 discretion determine to be in the best interest of the State
5-32 of Georgia.
5-33 SECTION 3.
5-34 That the authorization in this resolution to convey the
5-35 above-described property to Baldwin County shall expire
5-36 three years after the date that this resolution becomes
5-37 effective.

6- 1 SECTION 4.
6- 2 That the State Properties Commission is authorized and
6- 3 empowered to do all acts and things necessary and proper to
6- 4 effect such conveyance.
6- 5 SECTION 5.
6- 6 That the deed of conveyance shall be recorded by the grantee
6- 7 in the Superior Court of Baldwin County and a recorded copy
6- 8 shall be forwarded to the State Properties Commission.
6- 9 SECTION 6.
6-10 That the State of Georgia is the owner of the
6-11 above-described real property located in Bartow County and
6-12 that in all matters relating to the conveyance of the real
6-13 property the State of Georgia is acting by and through its
6-14 State Properties Commission.
6-15 SECTION 7.
6-16 That the above-described real property may be conveyed by
6-17 appropriate instrument to the Baroid Division of Dresser
6-18 Industries Inc. by the State of Georgia, acting by and
6-19 through the State Properties Commission for the
6-20 consideration of the fair market value or may be exchanged
6-21 for property or properties owned by the Baroid Division of
6-22 Dresser Industries Inc. of equal value and such further
6-23 consideration and provisions as the State Properties
6-24 Commission shall in its discretion determine to be in the
6-25 best interests of the State of Georgia.
6-26 SECTION 8.
6-27 That CSX Transportation shall surrender its leasehold
6-28 interest in the above-described property prior to its being
6-29 conveyed to the Baroid Division of Dresser Industries Inc.
6-30 SECTION 9.
6-31 That the authorization in this resolution to convey the
6-32 above-described property to the Baroid Division of Dresser
6-33 Industries Inc. shall expire three years after the date that
6-34 this resolution becomes effective.
6-35 SECTION 10.
6-36 That the State Properties Commission is authorized and
6-37 empowered to do all acts and things necessary and proper to
6-38 effect such conveyance.

7- 1 SECTION 11.
7- 2 That the deed of conveyance shall be recorded by the grantee
7- 3 in the Superior Court of Bartow County and a recorded copy
7- 4 shall be forwarded to the State Properties Commission.
7- 5 SECTION 12.
7- 6 That the State of Georgia is the owner of the
7- 7 above-described real property located in DeKalb County and
7- 8 that in all matters relating to the conveyance of the real
7- 9 property the State of Georgia is acting by and through its
7-10 State Properties Commission.
7-11 SECTION 13.
7-12 That the above-described real property may be conveyed by
7-13 appropriate instrument to the DeKalb County Board of
7-14 Education by the State of Georgia, acting by and through the
7-15 State Properties Commission for the consideration of $1.00,
7-16 so long as the property is used for a public purpose, and
7-17 such further consideration and provisions as the State
7-18 Properties Commission shall in its discretion determine to
7-19 be in the best interests of the State of Georgia.
7-20 SECTION 14.
7-21 That the authorization in this resolution to convey the
7-22 above-described property to the DeKalb County Board of
7-23 Education shall expire three years after the date that this
7-24 resolution becomes effective.
7-25 SECTION 15.
7-26 That the State Properties Commission is authorized and
7-27 empowered to do all acts and things necessary and proper to
7-28 effect such conveyance.
7-29 SECTION 16.
7-30 That the deed of conveyance shall be recorded by the grantee
7-31 in the Superior Court of DeKalb County and a recorded copy
7-32 shall be forwarded to the State Properties Commission.
7-33 SECTION 17.
7-34 That the State of Georgia is the owner of the
7-35 above-described real property located in Elbert County and
7-36 that in all matters relating to the conveyance of the real

8- 1 property the State of Georgia is acting by and through its
8- 2 State Properties Commission.
8- 3 SECTION 18.
8- 4 That the above-described real property may be conveyed by
8- 5 appropriate instrument to the City of Elberton, Elbert
8- 6 County, by the State of Georgia, acting by and through the
8- 7 State Properties Commission for the consideration of $1.00,
8- 8 so long as the property is used for a public purpose, and
8- 9 such further consideration and provisions as the State
8-10 Properties Commission shall in its discretion determine to
8-11 be in the best interests of the State of Georgia.
8-12 SECTION 19.
8-13 That the above-described real property shall not be conveyed
8-14 to the City of Elberton, Elbert County, until after the
8-15 Department of Defense and its National Guard activities and
8-16 facilities have been relocated to a new site.
8-17 SECTION 20.
8-18 That the authorization in this resolution to convey the
8-19 above-described property to the the City of Elberton, Elbert
8-20 County, shall expire five years after the date that this
8-21 resolution becomes effective.
8-22 SECTION 21.
8-23 That the State Properties Commission is authorized and
8-24 empowered to do all acts and things necessary and proper to
8-25 effect such conveyance.
8-26 SECTION 22.
8-27 That the deed of conveyance shall be recorded by the grantee
8-28 in the Superior Court of Elbert County and a recorded copy
8-29 shall be forwarded to the State Properties Commission.
8-30 SECTION 23.
8-31 That the State of Georgia is the owner of the
8-32 above-described real property located in Floyd County and
8-33 that in all matters relating to the conveyance of the real
8-34 property the State of Georgia is acting by and through its
8-35 State Properties Commission.

9- 1 SECTION 24.
9- 2 That the above-described real property may be conveyed by
9- 3 appropriate instrument to Floyd County by the State of
9- 4 Georgia, acting by and through the State Properties
9- 5 Commission for the consideration of $1.00, so long as the
9- 6 property is used for a public purpose, and such further
9- 7 consideration and provisions as the State Properties
9- 8 Commission shall in its discretion determine to be in the
9- 9 best interests of the State of Georgia.
9-10 SECTION 25.
9-11 That the above-described real property shall not be conveyed
9-12 to Floyd County until after the Georgia Forestry Commission
9-13 has relocated its activities and facilities to a new site.
9-14 SECTION 26.
9-15 That the authorization in this resolution to convey the
9-16 above-described property to Floyd County shall expire five
9-17 years after the date that this resolution becomes effective.
9-18 SECTION 27.
9-19 That the State Properties Commission is authorized and
9-20 empowered to do all acts and things necessary and proper to
9-21 effect such conveyance.
9-22 SECTION 28.
9-23 That the deed of conveyance shall be recorded by the grantee
9-24 in the Superior Court of Floyd County and a recorded copy
9-25 shall be forwarded to the State Properties Commission.
9-26 SECTION 29.
9-27 That the State of Georgia is the owner of the
9-28 above-described real property located in Glascock County and
9-29 that in all matters relating to the conveyance of the real
9-30 property the State of Georgia is acting by and through its
9-31 State Properties Commission.
9-32 SECTION 30.
9-33 That the above-described real property may be conveyed by
9-34 appropriate instrument to Glascock County by the State of
9-35 Georgia, acting by and through the State Properties
9-36 Commission for the consideration of $1.00, so long as the
9-37 property is used for a public purpose, and such further
9-38 consideration and provisions as the State Properties

10- 1 Commission shall in its discretion determine to be in the
10- 2 best interests of the State of Georgia.
10- 3 SECTION 31.
10- 4 That the above-described real property shall not be conveyed
10- 5 to Glascock County until after the Georgia Forestry
10- 6 Commission has relocated its activities and facilities to a
10- 7 new site.
10- 8 SECTION 32.
10- 9 That the authorization in this resolution to convey the
10-10 above-described property to Glascock County shall expire
10-11 five years after the date that this resolution becomes
10-12 effective.
10-13 SECTION 33.
10-14 That the State Properties Commission is authorized and
10-15 empowered to do all acts and things necessary and proper to
10-16 effect such conveyance.
10-17 SECTION 34.
10-18 That the deed of conveyance shall be recorded by the grantee
10-19 in the Superior Court of Glascock County and a recorded copy
10-20 shall be forwarded to the State Properties Commission.
10-21 SECTION 35.
10-22 That all laws and parts of laws in conflict with this
10-23 resolution are repealed.
