      SENATE RESOLUTION 75

           Egan of the 40th and others 
 
                             A RESOLUTION 
 
  1- 1  Creating the Senate Certificate of Need for Long-term Care 
  1- 2  Facilities Study Committee; and for other purposes. 
 
  1- 3  WHEREAS, congregate senior housing and continuing care 
  1- 4  retirement communities (CCRC's) are becoming increasingly 
  1- 5  popular among seniors in the United States; and 
 
  1- 6  WHEREAS, such developments that cater to this public demand 
  1- 7  have attracted seniors to relocate to states which encourage 
  1- 8  the development of continuing of care retirement 
  1- 9  communities, resulting in a loss of economic resources from 
  1-10  states such as Georgia which otherwise have the potential to 
  1-11  develop a significant senior housing industry; and 
 
  1-12  WHEREAS, the availability of and access to all components of 
  1-13  health and medical care for seniors is critical to the 
  1-14  successful development of a viable retirement community, and 
  1-15  skilled nursing facilities are one of the required care 
  1-16  components of such a community; and 
 
  1-17  WHEREAS, this state effectively controls such access via 
  1-18  certificate of need laws and regulations pertaining to 
  1-19  components of care such as skilled nursing, thus resulting 
  1-20  in a regulatory environment severely restricting and 
  1-21  restraining the development of a high-quality growth 
  1-22  industry in this state. 
 
  1-23  NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is 
  1-24  created the Senate Certificate of Need for Long-term Care 
  1-25  Facilities Study Committee to be composed of five members of 
  1-26  the Senate to be appointed by the President of the Senate. 
  1-27  The President of the Senate shall designate a member of the 
  1-28  committee as chairperson of the committee.  The chairperson 
  1-29  shall call all meetings of the committee. 
 
  1-30  BE IT FURTHER RESOLVED that the committee shall undertake a 
  1-31  study of the conditions, needs, issues, and problems of CCRC 
  1-32  development and recommend any actions or legislation which 
  1-33  the committee deems necessary or appropriate.  The committee 
  1-34  may conduct such meetings at such places and at such times 
  1-35  as it may deem necessary or convenient to enable it to 
  1-36  exercise fully and effectively its powers, perform its

  2- 1  duties, and accomplish the objectives and purposes of this 
  2- 2  resolution.  The members of the committee shall receive the 
  2- 3  allowances authorized for legislative members of interim 
  2- 4  legislative committees but shall receive the same for not 
  2- 5  more than five days unless additional days are authorized. 
  2- 6  The funds necessary to carry out the provisions of this 
  2- 7  resolution shall come from the funds appropriated to the 
  2- 8  Senate.  In the event the committee makes a report of its 
  2- 9  findings and recommendations, with suggestions for proposed 
  2-10  legislation, if any, such report shall be made on or before 
  2-11  December 15, 1999.  The committee shall stand abolished on
