Senator Gingrey of the 37th offered the following
amendment:
Amend HB 1179 by striking line 1 of page
1 and inserting in its place "To amend Article 2 of Chapter 5 of Title 40 of the
Official Code of Georgia Annotated, relating to issuance, expiration, and
renewal of licenses, so as to change certain provisions
regarding".
By inserting between "applications;"
and "to" on line 4 of page 1 the
following:
"to
authorize licensed driver training instructors to act as driver´s license
examiners;".
By
striking lines 8, 9, and 10 of page 1 and inserting in their place "Article 2 of
Chapter 5 of Title 40 of the Official Code of Georgia Annotated, relating to
issuance, expiration, and renewal of licenses, is amended by striking subsection
(a) of Code Section 40-5-26, relating to applications of minors for
drivers´ licenses and distinctive licenses for persons under age 21, and
inserting in its place a new subsection (a) to read as
follows:".
By striking lines 22 and 23 of page 1
and inserting in their place the following:
"SECTION
2.
Said article is further amended by striking subsection (b)
of Code Section 40-5-27, relating to examination of applicants for drivers´
licenses, and inserting in lieu thereof the
following:
'(b)(1) The department shall make
provision for giving an examination either in the county where the applicant
resides or at another place reasonably convenient to the applicant. The
examination, with the exception of those required for a commercial driver´s
license, commercial driver´s license permit, or noncommercial Class A, B,
or M license, shall be given at least once each month in each county of the
state.
(2) The on-the-road driving test portion of
an examination, when applicable, may be administered either by a department
employee appointed for such purpose or, pursuant to contract with the
department, by a driver training instructor who is licensed under Chapter 13 of
Title 43 to provide instruction for the class of license which the applicant
seeks. In the event that a licensed driver training instructor administers such
on-the-road driving test, the results shall be reported to the department in
accordance with rules or regulations promulgated thereby, and the licensed
driver training instructor shall not receive any compensation from the
department but may charge the applicant a fee, payable to the driver training
instructor, of not more than $50.00 for administering such
test.'
SECTION 3.
All laws and parts of laws in conflict with this Act are
repealed."
