A BILL TO BE
ENTITLED
AN ACT
To amend Chapter 43 of Title 33 of the Official Code of
Georgia Annotated, relating to medicare supplemental insurance, so as to provide
that insurers who offer medicare supplemental insurance policies in this state
shall make available certain policies to persons under the age of 65 who, as a
result of a disability, qualify for medicare under certain circumstances and
conditions; to provide for related matters; to provide an effective date; to
repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 43 of Title 33 of the Official Code of Georgia
Annotated, relating to medicare supplemental insurance, is amended by adding a
new Code Section 33_43_3.1 to read as
follows:
"33_43_3.1.
(a)
All issuers that deliver or issue for delivery in this state medicare
supplemental policies shall make available to persons under the age of 65 years,
who, due to a disability, are eligible for medicare, at least medicare
supplemental policy plans B and I as such plans are presently or may hereafter
be defined by the Commissioner of Insurance by rule or
regulation.
(b) Such medicare supplemental policies
shall be issued on the same terms and under the same conditions as medicare
supplemental policies issued to persons who are 65 years of age or
older.
(c) Issuers may elect to offer other medicare
supplemental policy plans to persons under 65 years of age who are eligible for
medicare as a result of a disability in addition to the plans specified in this
Code section.
(d) Nothing contained in subsection (a)
of this Code section shall require an issuer to offer a medicare supplemental
policy to persons under 65 years of age who are eligible for medicare as a
result of a disability if the issuer does not offer such policy to persons who
are 65 years of age or
older."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
