A BILL TO BE ENTITLED
AN ACT

To amend Chapter 2 of Title 47 of the Official Code of Georgia Annotated, relating to the Employees´ Retirement System of Georgia, so as to provide for the application for certain creditable service in such retirement system; to provide times for the submission of an application for a disability retirement allowance and proof of disability; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 47 of the Official Code of Georgia Annotated, relating to the Employees´ Retirement System of Georgia, is amended by inserting immediately following Code Section 47_2_90 a new Code section to read as follows:
"47_2_90.1.
Unless otherwise expressly provided, any member desiring to obtain creditable service in this retirement system for any service allowed by this chapter shall make application to the board of trustees of this retirement system in such manner as the board deems appropriate, shall supply such information and documentation as the board deems necessary, and shall tender to the board of trustees along with his or her application the full amount required by the legislation granting such creditable service."

SECTION 2.
Said chapter is further amended by inserting at the end of Code Section 47_2_221, relating to disability allowances payable to personnel for certain disabilities arising in the line of duty, a new subsection to read as follows:
"(c) Application for such disability allowance provided by subsections (a) and (b) of this Code section may only be filed by an active member of this retirement system. The medical board shall not consider any evidence of such disability which is not submitted within 12 months after the date the member submits his or her first application for a disability retirement."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
