A BILL TO BE ENTITLED
AN ACT

To amend Code Section 40-5-147 of the Official Code of Georgia Annotated, relating to requirements for issuance of commercial driver´s license or instruction permit, so as to change certain age requirements; to provide effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

PART 1
SECTION 1-1.

Code Section 40-5-147 of the Official Code of Georgia Annotated, relating to requirements for issuance of commercial driver´s license or instruction permit, is amended by striking paragraph (1) of subsection (a) and inserting in lieu thereof the following:
"(a)(1) Except as provided in Code Section 40-5-148, no person may be issued a commercial driver´s license unless that person is a resident of this state, is at least 18 21 years of age, has passed a knowledge and skills test for driving a commercial motor vehicle which complies with minimum federal standards established by federal regulations enumerated in 49 C.F.R. Part 383, subparts G and H, and has satisfied all other requirements of the Commercial Motor Vehicle Safety Act of 1986, Title XII of Public Law 99-570, in addition to any other requirements imposed by state law or federal regulation. The tests shall be prescribed and conducted by the Department of Public Safety in English only. Any commercial driver´s license issued prior to July 1, 2001, to a person who on such date does not meet the age requirement of this paragraph shall be and remain invalid."

SECTION 1-2.
Said Code section is further amended by striking paragraph (1) of subsection (c) and inserting in lieu thereof the following:
"(c)(1) A commercial driver´s instruction permit may be issued to any individual who holds a valid noncommercial Class C license or has passed all required tests for the operation of a noncommercial Class C vehicle and is 18 21 years of age. Any commercial driver´s instruction permit issued prior to July 1, 2001, to a person who on such date does not meet the age requirement of this paragraph shall be and remain invalid."

PART 2
SECTION 2-1.

Code Section 40-5-147 of the Official Code of Georgia Annotated, relating to requirements for issuance of commercial driver´s license or instruction permit, is amended by striking paragraph (1) of subsection (a) and inserting in lieu thereof the following:
"(a)(1) Except as provided in Code Section 40-5-148, no person may be issued a commercial driver´s license unless that person is a resident of this state, is at least 18 21 years of age, has passed a knowledge and skills test for driving a commercial motor vehicle which complies with minimum federal standards established by federal regulations enumerated in 49 C.F.R. The tests shall be prescribed and conducted by the department in English only. PART 3
SECTION 3-1.

(a) This Act shall become effective July 1, 2001, except as otherwise provided by subsection (b) of this section.
(b) Each provision amended in Part II of this Act shall become effective and supersede that respective provision amended in Part I of this Act on July 1, 2001, or on such date thereafter as that same provision, as amended by an Act approved April 28, 2000 (Ga. L. 2000, p. 951), becomes fully effective pursuant to Section 13-1 of that 2000 Act, whichever is later.

SECTION 3-2.
All laws and parts of laws in conflict with this Act are repealed.
