A BILL TO BE ENTITLED
AN ACT

To amend Chapter 12 of Title 50 of the Official Code of Georgia Annotated, relating to commissions and other agencies, so as to create the Georgia Commission on African American Males; to provide for the membership of such commission; to provide for terms; to provide for the commission´s powers and duties; to provide for reimbursement of members´ expenses; to provide for other matters relative thereto; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 12 of Title 50 of the Official Code of Georgia Annotated, relating to commissions and other agencies, is amended by inserting at the end thereof a new Article 9 to read as follows:

“ARTICLE 9

50-12-140.
(a) There is created the Georgia Commission on African American Males. The commission shall be composed of 15 members to be appointed as follows:
(1) Five members shall be appointed by the Governor;
(2) Five members shall be appointed by the President of the Senate; and
(3) Five members shall be appointed by the Speaker of the House of Representatives.
(b) The members of the commission shall be men and women of recognized ability and achievement. All vacancies shall be filled for the unexpired term by the originating appointing official. Members shall serve for terms of four years and no member may serve for more than two consecutive terms.

50-12-141.
The commission shall elect a chairperson, vice chairperson, and a secretary from among its members for terms of two years, and any member shall be eligible for successive elections to such office by the commission. A quorum for transacting business shall be a majority of the members of the commission.

50-12-142.
(a) The commission shall have the following powers and duties:
(1) To determine the scope and nature of the studies and research to be undertaken by the commission, including, but not limited to:
(A) Educational needs and opportunities for African American males;
(B) African American male health issues;
(C) Employment policies in the public and private sectors and their impact on the wage-earning capacity of African American males; and
(D) Criminal justice issues relating to African American males;
(2) To collect and disseminate information regarding the status of African American males in the State of Georgia and the nation;
(3) To review and analyze the laws of the State of Georgia and their impact on the lives of the African American males of this state;
(4) To consult with and advise the Governor and any state department, agency, board, commission, or authority on matters pertaining to the status of African American males;
(5) To accept public or private grants, devises, and bequests; and
(6) To hold public hearings, conduct studies, or take any other action the commission deems necessary or incidental to the performance of its duties.
(b) The commission shall be authorized to enter into all contracts or agreements necessary or incidental to the performance of its duties.
(c) All executive departments, agencies, boards, commissions, and authorities shall cooperate with the commission in the performance of its duties.

50-12-143.
The members of the commission shall be reimbursed for necessary expenses incurred while conducting the business of the commission from public or private grants, devises, or bequests received by the commission.

50-12-144.
The commission shall publish an annual report summarizing the activities, findings, and recommendations of the commission. The report shall be submitted to the Governor, the President of the Senate, the Speaker of the House of Representatives, and all members of the Senate and the House of Representatives not later than November 1 of each year.”

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
