A BILL TO BE
ENTITLED
AN ACT
To amend Article 2 of Chapter 5 of Title 40 of the
Official Code of Georgia Annotated, relating to issuance, expiration, and
renewal of
drivers´
licenses, so as to provide for the processing of applications and examination of
applicants for Class P instructional permits and noncommercial Class C and Class
D
drivers´
licenses by driver training schools; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Article 2 of Chapter 5 of Title 40 of the Official Code of
Georgia Annotated, relating to issuance, expiration, and renewal of
drivers´
licenses, is amended by adding a new Code Section 40-5-37 to read as
follows:
“40-5-37.
(a)
The commissioner is authorized and directed to promulgate rules and regulations
providing for the processing of applications and examination of applicants for
Class P instructional permits and noncommercial Class C and Class D
drivers´
licenses by driver training schools licensed under Chapter 13 of Title 43 on
behalf of the department.
(b) Any driver training
school authorized to process applications and examine applicants for permits and
licenses pursuant to this Code section shall do so only for those persons who
have successfully completed a department approved course of driver education at
such school.
(c) Any person submitting an
application to or being examined by a driver training school in lieu of the
department pursuant to this Code section shall be subject to the same
requirements for licensing as otherwise provided by law. Any driver training
school acting pursuant to this Code section shall transmit the completed
application, including any required fee, of any person who has successfully
passed all examinations required by law to the department for purposes of
issuance of such permit or license.
(d) The department
is further authorized and directed to promulgate rules and regulations
establishing standards for approval of any driver education course for purposes
of this Code section, provided that such course shall be designed to educate
young drivers regarding safe driving practices and the traffic laws of this
state and to train young drivers in the safe operation of motor vehicles.
(e) No driver training school shall be required to
act as a
driver´s
license application processor or applicant examiner on behalf of the
department.”
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
