A BILL TO BE
ENTITLED
AN ACT
To amend Chapter 6A of Title 34 of the Official Code of
Georgia Annotated, the "Georgia Equal Employment for Persons With Disabilities
Code," so as to change a definition to include persons with certain blood
disorders as persons with disabilities; to repeal conflicting laws; and for
other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 6A of Title 34 of the Official Code of Georgia
Annotated, the "Georgia Equal Employment for Persons With Disabilities Code," is
amended by striking paragraph (3) of Code Section 34-6A-2, relating to
definitions, and inserting in its place the
following:
"(3)
'Individual with disabilities' means any person who
has:
(A)(i) Has a
physical or mental impairment which substantially limits one or more of such
person´s
major life activities and who has;
or
(ii) Has any of the following blood
disorders, whether or not such disorder limits one or more of such
person´s
major life activities:
(I) Sickle cell
anemia;
(II) Beta thalasemia or
Cooley´s
anemia; or
(III) Tay-Sachs disease;
and
(B) Has a record of such impairment
or disorder.
The term 'individual with
disabilities' shall not include any person who is addicted to the use of any
drug or illegal or federally controlled substance nor addiction to the use of
alcohol."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
