A BILL TO BE
ENTITLED
AN ACT
To amend Code Section 31-22-9 of the Official Code of
Georgia Annotated, relating to applicability of the clinical laboratory
licensing requirements, so as to clarify an exemption regarding capillary blood
tests; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 31-22-9 of the Official Code of Georgia
Annotated, relating to applicability of the clinical laboratory licensing
requirements, is amended by striking subsection (b) thereof and inserting in its
place a new subsection to read as
follows:
"(b) This
chapter shall not apply to pharmacists licensed pursuant to Chapter 4 of Title
26 practicing in accordance with the provisions thereof who are performing
capillary blood tests and interpreting the results as a means to screen for or
monitor disease risk factors and facilitate patient education as authorized in
Code Section 26-4-4, so long as such capillary blood tests are available to and
for use by the public without licensure of the user of the test, but such
tests shall not be restricted to capillary blood tests which are only
available:
(1) For home use;
or
(2) Over the counter without
prescription."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
