A BILL TO BE
ENTITLED
AN ACT
To amend Part 2 of Article 3 of Chapter 5 of Title 12 of
the Official Code of Georgia Annotated, relating to ground-water use generally,
so as to provide that it shall be unlawful for any person to inject any
substance into an aquifer; to provide a penalty; to repeal conflicting laws; and
for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Part 2 of Article 3 of Chapter 5 of Title 12 of the Official
Code of Georgia Annotated, relating to ground-water use generally, is amended by
inserting at the end thereof the
following:
"12-5-108.
It shall be unlawful for any person to inject any
substance into an aquifer in this state; provided, however, that this Code
section shall not preclude the drilling of wells into an aquifer for the purpose
of withdrawing water in accordance with other provisions of this chapter. Any
person convicted of violating this Code section shall be incarcerated for not
less than five nor more than ten years or pay a fine not to exceed $1 million or
both."
SECTION 2.
This Act shall become effective upon its approval by the
Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are
repealed.
