A BILL TO BE ENTITLED
AN ACT

To amend Article 1 of Chapter 12 of Title 16 of the Official Code of Georgia Annotated, relating to general provisions relative to offenses against public health and morals, so as to define the offense of failing to supervise a minor; to provide for punishment; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 12 of Title 16 of the Official Code of Georgia Annotated, relating to general provisions relative to offenses against public health and morals, is amended by adding a new Code Section 16-12-1.2 to read as follows:
"16-12-1.2.
(a) A person commits the offense of failing to supervise a minor when:
(1) Such person is the minor´s parent or guardian; and
(2) The minor, after having committed any of the following acts, subsequently:
(A) Commits any act which would be a misdemeanor of a high and aggravated nature if committed by an adult;
(B) Commits any act which would be a felony if committed by an adult; or
(C) Violates a curfew established by ordinance or resolution of any city, county, or consolidated government.
(b) It shall not be a defense to the offense of failing to supervise a minor that the minor has not been formally adjudged to have committed a delinquent act nor has been found to be unruly or deprived.
(c) A person convicted of the offense of failing to supervise a minor shall be guilty of a misdemeanor and shall be punished by not less than 40 nor more than 80 hours of community service. Such community service shall be supervised under such terms and conditions as the judge shall impose."
SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
