AN ACT

To abolish the office of coroner of Clayton County and establish in its place the office of medical examiner of Clayton County pursuant to Code Section 45-16-80 of the O.C.G.A.; to provide for related matters; to provide for effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Pursuant to Code Section 45-16-80 of the O.C.G.A., the office of coroner of Clayton County is abolished and there is established in lieu thereof the office of medical examiner of Clayton County. The medical examiner shall have the qualifications, compensation, functions, powers, rights, and duties and shall serve and be appointed as specified in said Code section.

SECTION 2.
If the office of coroner of Clayton County is vacant on the date on which this Act is approved by the Governor or becomes law without such approval, then this Act shall become effective on that date. If the office of coroner is not vacant on that date but becomes vacant prior to January 1, 2005, then this Act shall become effective on the date on which the office becomes vacant. Otherwise, this Act shall become effective January 1, 2005. In no event shall any election be held or appointment be made to fill any vacancy in the office of coroner of Clayton County on or after the date on which this Act is approved by the Governor or becomes law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
