A BILL TO BE
ENTITLED
AN ACT
To amend Code Section 40-5-24 of the Official Code of
Georgia Annotated, relating to instruction permits, graduated licensing and
related restrictions, and temporary licenses, so as to change certain provisions
relating to nighttime driving restrictions for Class D licensees; to repeal
conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 40-5-24 of the Official Code of Georgia
Annotated, relating to instruction permits, graduated licensing and related
restrictions, and temporary licenses, is amended by striking subparagraph
(b)(2)(A) and inserting in lieu thereof the
following:
"(A)
Any Class D license holder shall not drive a Class C motor vehicle on the public
roads, streets, or highways of this state between the hours of 12:00 Midnight
and 6:00 A.M. eastern standard time or eastern daylight time, whichever is
applicable, unless such license holder is returning to his or her residence
from a group event or activity sponsored or sanctioned by either a secondary or
postsecondary school in which he or she is enrolled as a student or by a
religious organization, and he or she possesses a written authorization for such
purposes which is signed by a person over 21 years of age having responsibility
for supervising students or young persons attending such group event or activity
and which specifies the name, address, and driver´s license number of the
Class D license holder, the exact nature, date, and time of the event and the
name of the sponsoring or sanctioning organization, and the name, position,
address, and telephone number of the supervising adult;
and"
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
