AN ACT

To amend Article 1 of Chapter 11 of Title 4, the "Georgia Animal Protection Act," so as to authorize municipal and county governing authorities to enact and enforce ordinances which are not in conflict with the provisions of said article; to provide for notification of the Department of Agriculture of any local enforcement actions by local governing authorities; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 11 of Title 4, the "Georgia Animal Protection Act," is amended by inserting at the end thereof a new Code Section 4-11-17 to read as follows:
"4-11-17.
This article shall be cumulative and shall not prohibit the enactment and enforcement of local ordinances by a municipal or county governing authority on this subject which are not in conflict with this article; provided, however, that a municipal or county governing authority shall be required to provide timely written notice to the department of any enforcement action taken pursuant to such an ordinance against an operator licensed under this article who is alleged to be in violation of such local ordinance. The department shall be notified of the initiation of any such local enforcement action and of the final conclusions or ultimate outcome of any such action."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
