A BILL TO BE ENTITLED
AN ACT

To amend Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to elementary and secondary education, so as to provide for eligibility of students who attend private schools or home study programs for extracurricular programs offered at public schools under certain conditions; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to elementary and secondary education, is amended by adding at the end a new article to read as follows:

"ARTICLE 32
20-2-2090.
A student who attends a private school or home study program which meets the respective requirements therefor specified in Code Section 20-2-690 shall be eligible to participate in any extracurricular program offered in the public school which that student would otherwise be authorized to attend if that student meets the same requirements established for public school students in that program, other than attendance at that school. A public school shall have no obligation to provide transportation to or from that school for a student eligible for extracurricular programs pursuant to this Code section except that such student shall be eligible for transportation from the school to and from any extracurricular program in which the student is eligible to participate under the same conditions as public school participants in that program. A student otherwise eligible to participate in any extracurricular program pursuant to this Code section may not participate in that program if it is at least substantially similar to an extracurricular program in which that student participates in the private school that student attends."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
