AN ACT

To amend an Act known as the "Metropolitan Atlanta Rapid Transit Authority Act of 1965," approved March 10, 1965 (Ga. L. 1965, p. 2243), as amended, so as to provide that the police chief or chief executive officer of the security force created by said Act shall have the authority to administer the oath of office to any eligible peace officer employed as a member of such force; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act known as the "Metropolitan Atlanta Rapid Transit Authority Act of 1965," approved March 10, 1965 (Ga. L. 1965, p. 2243), as amended, is amended by striking subsection (o) of Section 8 and inserting in lieu thereof the following:
"(o) The power to contract for, or to provide and maintain, with respect to the facilities and property owned, leased, operated or under the control of the Authority, and within the territory thereof, a security force to protect persons and property, dispense unlawful or dangerous assemblages and assemblages which obstruct full and free passage, control pedestrian and vehicular traffic, and otherwise preserve and protect the public peace, health and safety. For these purposes, a member of such force shall be a peace officer and, as such, shall have authority and immunities equivalent to those of a peace officer of the municipality or county in which that person is discharging the duties as a member of such force. Peace officers employed under this subsection shall be personally liable to one who sustains special damages as a result of any official act of such officers if done oppressively, maliciously, corruptly, or without authority of law. The chief of police or chief executive officer of such force shall be authorized to administer an oath of office to any individual employed by the Authority as a member of such force who has met the requirements for certification as a peace officer under the laws of this state."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
