A BILL TO BE ENTITLED
AN ACT

To amend Part 5 of Article 8 of Chapter 2 of Title 47 of the Official Code of Georgia Annotated, relating to provisions applicable to certain law enforcement personnel under the Employees´ Retirement System of Georgia, so as to provide that under certain conditions, persons employed as correction officers, parole officers, and probation officers may retire after accruing 25 years of creditable service without regard to age; to provide conditions for an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 5 of Article 8 of Chapter 2 of Title 47 of the Official Code of Georgia Annotated, relating to provisions applicable to certain law enforcement personnel under the Employees´ Retirement System of Georgia, is amended by inserting at the end thereof the following:
"47-2-226.
Any other provision of this chapter to the contrary notwithstanding, any member who is employed by the Department of Corrections as a prison guard, by the State Board of Pardons and Paroles as a parole officer, or by the Department of Corrections as a probation officer and who has at least 25 years of creditable service may, upon written application to the board of trustees, retire on a service retirement allowance without regard to age, provided that such member has at least ten years of actual service in any such position in a nonsupervisory capacity."

SECTION 2.
This Act shall become effective on July 1, 2002, only if it is determined to have been concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not become effective and shall be automatically repealed in its entirety on July 1, 2002, as required by subsection (a) of Code Section 47-20-50.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
