Senate Resolution 63

A RESOLUTION

Proposing an amendment to the Constitution so as to authorize the General Assembly to provide by law for the creation of a driver education fund within the state treasury from which funds shall be disbursed to local school systems to implement and fund driver education programs; to authorize the levy of a surcharge on driver´s license application fees and the appropriation of the proceeds of such surcharges to the fund; to provide that moneys appropriated to such fund shall not lapse; to provide for related matters; to provide for the submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article III, Section IX, Paragraph VI of the Constitution is amended by inserting a new subparagraph to be designated subparagraph (l) to read as follows:
"(l) The General Assembly is authorized to provide by general law for the creation of a driver education fund from which funds shall be disbursed to local school systems for the implementation and maintenance of driver education programs for secondary schools. The General Assembly is authorized to provide by general law for a surcharge on driver license application fees and to appropriate all of the proceeds of such surcharge to the driver education fund. Moneys appropriated to the fund authorized by this subparagraph shall not be subject to the provisions of Article III, Section IX, Paragraph IV(c) relative to the lapsing of appropriated funds. An Act creating such fund and making such provisions effective January 1, 2002, or later may originate or have originated in the Senate or the House of Representatives. The General Assembly may provide by general law for the administration of such fund by such state agency as the General Assembly shall determine."

SECTION 2.
The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following:
"(  )  YES

(  )  NO


Shall the Constitution be amended so as to authorize the creation of a driver education fund; the levy of a surcharge on driver´s license application fees and the appropriation of the proceeds of such surcharges to the fund; and the use of the fund for the establishment of driver education programs by local school systems?"

All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
