Senators Ray of the 48th, Williams of the 6th, Tanksley of the 32nd, Paul of the 40th, Lee of the 29th and Price of the 56th offered the following amendment:

Amend the Senate Judiciary Committee substitute to Senate Bill 6EX2 by inserting after "information;" on line 5 of page 1 "to amend Code Section 15-12-165 of the Official Code of Georgia Annotated, relating to number of peremptory challenges, so as to change the number of peremptory challenges allowed in criminal cases;" and by inserting after line 21 on page 2 a new Section 1-1A to read as follows:
"SECTION 1-1A.
Code Section 15-12-165 of the Official Code of Georgia Annotated, relating to number of peremptory challenges, is amended by striking the section in its entirety and inserting in lieu thereof a new Code Section 15-12-165 to read as follows:
'15-12-165.
Every person indicted for a crime or offense may peremptorily challenge 12 of the jurors impaneled to try him. The state shall be allowed one-half the same number of peremptory challenges allowed to the accused; provided, however, in any case in which the state announces its intention to seek the death penalty, the person indicted for the crime may peremptorily challenge 20 jurors and the state shall be allowed one-half the same number of peremptory challenges allowed to the accused.'"
