A BILL TO BE
ENTITLED AN ACT
To amend Chapter 50 of the Official Code of Georgia
Annotated, relating to state government, so as to require the design,
construction, and maintenance of certain buildings and sites of certain
buildings be in compliance with Leadership in Energy and Environmental Design
Green Building Rating System standards to the extent practicable; to require
agencies and instrumentalities of the state or political subdivisions of the
state to seek certification; to provide for related matters; to repeal
conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 50 of the Official Code of Georgia Annotated,
relating to state government, is amended by inserting a new Code section to be
designated Code Section 50_16_20 to read as
follows: "50_16_20. (a)
As used in this Code section, the term 'LEED certification' means certification
as complying with the Leadership in Energy and Environmental Design (LEED) Green
Building Rating System standards relevant to the type of building.
(b) Every building erected on or after July 1, 2004,
that is designed or built wholly or partially with monies from the State of
Georgia and the site for each such building shall be designed, constructed, and
maintained in compliance with Leadership in Energy and Environmental Design
Green Building Rating System standards to the extent practicable. The agency or
instrumentality of the state or political subdivision of the state responsible
for each such building shall seek LEED certification at the earliest stage of
development of each such building and site and throughout the life of each such
building."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
