A BILL TO BE
ENTITLED AN ACT
To amend an Act placing the judge of the probate court and
the clerk of the Superior Court of Catoosa County, Georgia, on an annual salary
in lieu of fees, approved February 20, 1959 (Ga. L. 1959,
p. 2047), as amended, so as to increase the clerical help allowance of the
clerk of the Superior Court of Catoosa County; to provide an effective date; to
repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
An Act placing the judge of the probate court and the clerk
of the Superior Court of Catoosa County, Georgia, on an annual salary in lieu of
fees, approved February 20, 1959 (Ga. L. 1959, p. 2047), as
amended, is amended by striking Section 3 in its entirety and inserting in
lieu thereof a new Section 3 to read as follows:
"SECTION
3.
The maximum allowance to be paid for clerical help shall
be: Clerical help for the judge of probate
court $130,000.00 Clerical help for the clerk of the
superior court $215,000.00 All allowances payable under
this Act shall be payable directly by the county treasurer to the person or
persons performing such clerical help. No person performing such clerical help
for the judge of the probate court shall be related to said judge closer than
the fifth degree of consanguinity or affinity. The allowances provided in this
section shall be used to employ full-time clerical help. In no event shall such
allowances be used to pay bonuses to full-time employees or part-time clerical
help. In the event the maximum allowance for clerical help is not needed for
such purposes, then the unused portion thereof shall remain as a part of the
general funds of the
county."
SECTION 2.
This Act shall become effective on January 1,
2005.
SECTION 3.
All laws and parts of laws in conflict with this Act are
repealed.
