A BILL TO BE
ENTITLED AN ACT
To amend Chapter 21 of Title 33 of the Official Code of
Georgia Annotated, relating to health maintenance organizations, so as to
include services for mental disorders in point-of-service options in health
benefit plan coverage through a health maintenance organization; to provide for
related matters; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 21 of Title 33 of the Official Code of Georgia
Annotated, relating to health maintenance organizations, is amended by striking
paragraph (3) of subsection (b) and subsection (c) of Code Section 33-21-29,
relating to point-of-service option for persons offered health care coverage
through a health maintenance organization, and inserting in their respective
places the
following: "(3)
'Point-of-service option' means a delivery system that permits an enrollee of a
health maintenance organization to receive services including services for
mental disorders as defined in paragraph (2) of subsection (a) of Code Section
33-24-28.1 outside the provider panel of the health maintenance organization
under the terms and conditions of the
enrollee´s
contract with the health maintenance
organization." "(c)
If the only type of insurance that an employer offers to eligible employees or
individuals is health benefit plan coverage through a health maintenance
organization, then the health maintenance organization with which such employer
contracts to provide such coverage shall offer or make arrangements for the
offering of a point-of-service option which shall include services for mental
disorders as defined in paragraph (2) of subsection (a) of Code Section
33-24-28.1 to such employer for the
employer´s
eligible employees or individuals, and each such eligible employee or individual
shall have the right to accept or reject such
option."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
