A BILL TO BE
ENTITLED AN ACT
To amend Code Section 3-6-32 of the Official Code of Georgia
Annotated, relating to the shipment of wine by a winery to consumers in this
state, so as to provide that consumers may purchase wine electronically by means
of Internet communications; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 3-6-32 of the Official Code of Georgia
Annotated, relating to the shipment of wine by a winery to consumers in this
state, is amended by striking said Code section in its entirety and inserting in
lieu thereof the
following: "3-6-32. (a)
Notwithstanding any other provision of this title to the contrary, a winery
located within this state or outside this state that holds a federal basic wine
manufacturing permit, whether licensed under this title or not and without
regard to brand or label registrations or designations of wholesalers pursuant
to Code Section 3-6-22, shall be permitted to ship wine directly to consumers in
this state for personal or household use under the following
circumstances: (1) The consumer must purchase the wine
while physically present on the premises of the winery or electronically by
means of computer Internet communications; (2) The
winery must verify that the consumer purchasing the wine is of the age required
by Code Section 3-3-23 and is not licensed pursuant to this title;
and (3) No winery shall ship in excess of five cases
of any brand or combination of brands to any one consumer or any one address in
this state in any calendar year. (b) The commissioner
may promulgate such rules and regulations as are necessary and appropriate for
the enforcement of this Code
section."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
