A BILL TO BE ENTITLED
AN ACT

To amend an Act providing for the compensation of certain county officers and officials of DeKalb County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, particularly by an Act approved April 4, 1997 (Ga. L. 1997, p. 3822), so as to withdraw the authority of the chief executive officer and the members of the board of commissioners of DeKalb County to fix the salary, compensation, expenses, and expenses in the nature of compensation paid to the chief executive officer and the members of such board of commissioners; to provide for the authority for such withdrawal of authority; to change the compensation of the chief executive officer and members of the Board of County Commissioners of DeKalb County; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act providing for the compensation of certain county officers and officials of DeKalb County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, particularly by an Act approved April 4, 1997 (Ga. L. 1997, p. 3822), is amended by striking Section 2.1, which reads as follows:

"SECTION 2.1.
Notwithstanding any other provisions of law to the contrary, the chief executive officer of DeKalb County shall receive an annual salary of $93,806.00, and the members of the Board of County Commissioners shall receive an annual salary of $19,443.00.",

and inserting in its place the following:

"SECTION 2.1.
(a) The authority of the chief executive officer and the members of the board of commissioners of DeKalb County to fix the salary, compensation, expenses, and expenses in the nature of compensation paid to the chief executive officer and the members of such board of commissioners is withdrawn pursuant to subsection (c) of Code Section 36-5-24 of the O.C.G.A., as amended. Any action taken by such chief executive officer and such board prior to the effective date of this Act to change such salary, compensation, expenses, and expenses in the nature of compensation (specifically including a resolution to amend the salary and compensation of the members of the governing authority of DeKalb County, adopted by the Board of County Commissioners of DeKalb County on February 24, 2004, and approved by the chief executive officer of DeKalb County on February 24, 2004) shall cease to be effective.
(b) Notwithstanding any other provisions of law to the contrary, the chief executive officer of DeKalb County and the members of the Board of County Commissioners shall continue to receive the same salaries provided by law as of January 1, 2004, until otherwise provided by Act of the General Assembly."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
