A BILL TO BE ENTITLED
AN ACT

To amend an Act providing a new charter for the City of Colquitt, Georgia, approved April 16, 1999 (Ga. L. 1999, p. 4502), so as to change the provisions regarding vacancies and the city manager; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act providing a new charter for the City of Colquitt, Georgia, approved April 16, 1999 (Ga. L. 1999, p. 4502), is amended by striking subsection (c) of Section 2.12 and inserting in its place the following:
"(c) In the event that the office of mayor or councilmember shall become vacant for any reason other than expiration of term:
(1) If the vacancy occurs within the final 27 months of the term of office, the city council or those remaining shall appoint a successor for the remainder of the term;
(2) If the vacancy occurs before the final 27 months of the term of office, the city council or those remaining shall appoint a person to fill such vacancy until a successor is elected at a special election which shall be conducted at the time of the next municipal general election which is held following the occurrence of such vacancy.
Persons selected to fill the remainder of a term of office shall serve until their successors are elected and qualified."

SECTION 2.
Said Act is further amended by striking Section 3.21 thereof and inserting in its place the following:
"SECTION 3.21.
City manager; appointment; qualifications; compensation.

By a majority vote, the city council shall appoint a city manager for an indefinite term and shall fix his or her compensation. The manager shall be appointed solely on the basis of his or her executive and administrative qualifications, with special reference to actual experience in or knowledge of accepted practice in respect to the duties of the office. At the time of his or her appointment, the appointee need not be a resident of the city or state, but during the manager´s tenure of office, he or she shall reside within either the City of Colquitt or Miller County. No councilmember shall receive such appointment during the term for which the manager shall have been appointed, nor within one year after the expiration of the councilmember´s term."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
