A BILL TO BE
ENTITLED AN ACT
To amend Chapter 1 of Title 20 of the Official Code of
Georgia Annotated, relating to general provisions relative to education, so as
to provide for offenses relating to giving or receiving compensation as an
inducement for an employee of a local board of education, local unit of
administration, or public postsecondary institution of education to recommend a
product, item, goods, or services for purchase or lease by a student; to provide
for criminal penalties; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 1 of Title 20 of the Official Code of Georgia
Annotated, relating to general provisions relative to education, is amended by
inserting a new Code section to be designated Code Section 20-1-10 to read as
follows: "20-1-10. (a)
It shall be unlawful for any employee of a local school board, local unit of
administration, or public postsecondary institution of education to receive
compensation from an owner or manufacturer of any item or product or from a
vendor of any goods or services as an inducement for recommending such item or
product or the goods or services of such vendor for purchase or lease by a
student in a local school system or public postsecondary institution of
education unless the source, nature, and amount of compensation is disclosed in
writing to the student and to the parents of the student if the student is a
minor. (b) It shall be unlawful for any owner or
manufacturer of any item or product or for a vendor of any goods or services to
offer or provide compensation to an employee of a local school board, local unit
of administration, or public postsecondary institution of education as an
inducement for such employee to recommend such item or product or the goods or
services of such vendor for purchase or lease by a student in a local school
system or public postsecondary institution of education unless the source,
nature, and amount of compensation is disclosed in writing to the student and to
the parents of the student if the student is a
minor. (c) Any person who violates subsection (a) or
(b) of this Code section shall be guilty of a misdemeanor of a high and
aggravated nature and upon conviction thereof shall be punished as provided in
Code Section
17-10-4."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
