A BILL TO BE
ENTITLED
AN ACT
AN ACT
To amend Code Section 12-5-295 of the Official Code of
Georgia Annotated, relating to applicability of the Coastal Marshlands
Protection Act of 1970, so as to change certain provisions relating to
inapplicability of said Act to building of private docks; to repeal conflicting
laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 12-5-295 of the Official Code of Georgia
Annotated, relating to applicability of the Coastal Marshlands Protection Act of
1970, is amended by striking paragraph (7) and inserting in lieu thereof the
following:
"(7) The building of private docks on pilings, the walkways of which are above the marsh grass not obstructing tidal flow, by the owners of tracts of real property zoned for detached single-family residences which tracts are located on high land adjoining such docks; or"
"(7) The building of private docks on pilings, the walkways of which are above the marsh grass not obstructing tidal flow, by the owners of tracts of real property zoned for detached single-family residences which tracts are located on high land adjoining such docks; or"
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
