A BILL TO BE
ENTITLED AN ACT
To amend Part 1 of Article 3 of Chapter 5 of Title 48 of the
Official Code of Georgia Annotated, relating to tax receivers, so as to change
certain provisions regarding the accumulation of statistical information with
respect to taxpayers; to require the accumulation of certain additional
information; to provide for confidentiality with respect to such information; to
provide for authorized uses of such information; to provide for applicability of
certain provisions regarding geographic information systems; to provide for
related matters; to provide for an effective date; to repeal conflicting laws;
and for other purposes.
BE IT ENACTED BY THE
GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Part 1 of Article 3 of Chapter 5 of Title 48 of the Official
Code of Georgia Annotated, relating to tax receivers, is amended by striking
Code Section 48_5_109, relating to the accumulation of statistical information
with respect to taxpayers, and inserting in its place a new Code Section
48_5_109 to read as
follows: "48_5_109. (a)
Each tax receiver and tax commissioner shall accumulate statistical information,
in regard to taxpayers, of such nature as required by the commissioner or
as they deem to be of benefit to the commissioner. Nothing contained in this
Code section shall preclude or prohibit the commissioner from collecting such
information as he or she deems necessary and beneficial in discharging
the official duties of his or her office. (b)
All such statistical information shall be privileged and confidential to the
same extent and under the same conditions as provided under Code Section
48_2_15. (c) Subsection (b) of this Code
section shall not prohibit a county or municipality from otherwise exercising
any power or authority granted to it with respect to geographic information
systems pursuant to Code Section
50_29_2."
SECTION 2.
This Act shall become effective upon its approval by the
Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are
repealed.
