A BILL TO BE
ENTITLED AN ACT
To amend Code Section 19-6-5 of the Official Code of Georgia
Annotated, relating to factors in determining the amount of alimony and the
effect of remarriage on obligations for alimony, so as to change the length of
time alimony can be awarded; to establish the amount of alimony that can be
awarded; to provide for related matters; to repeal conflicting laws; and for
other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 19-6-5 of the Official Code of Georgia
Annotated, relating to factors in determining the amount of alimony and the
effect of remarriage on obligations for alimony, is amended by striking
subsection (b) in its entirety and inserting in lieu thereof a new subsection
(b) and by adding a new subsection (c) to read as
follows: "(b)
All obligations for permanent alimony, however created, the time for performance
of which has not arrived, shall terminate upon remarriage of the party to whom
the obligations are owed unless otherwise provided, but in no circumstance
shall the length of time for which permanent alimony is awarded exceed
one-fourth of the length of time of the
marriage. (c) The total amount of alimony
awarded on a monthly basis shall not exceed 10 percent of the gross monthly
income of the party obligated to pay
alimony."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
