A BILL TO BE
ENTITLED AN ACT
To amend Article 6 of Chapter 7 of Title 47 of the Official
Code of Georgia Annotated, relating to retirement allowances and benefits
regarding The Georgia Firefighters´ Pension Fund, so as to provide for the
employment of retired firefighters; to provide for procedures, conditions, and
limitations; to provide for conditions for an effective date and automatic
repeal; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Article 6 of Chapter 7 of Title 47 of the Official Code of
Georgia Annotated, relating to retirement allowances and benefits regarding The
Georgia Firefighters´ Pension Fund, is amended by adding a new Code section
immediately following Code Section 47_7_100, to be designated Code Section
47_7_100.1, to read as
follows: "47_7_100.1. (a)
As used in this Code section, the term 'retired firefighter' means a member of
this retirement system who retires on a service retirement with at least 25
years of creditable service and after attaining the age of
55. (b) Any other provision of this article to the
contrary notwithstanding, a retired firefighter may return to service as a
firefighter for a total of not more than five years if he or she is employed
solely under the conditions contained in this Code section and such
member´s benefits under this article shall not be affected. Any such
retired firefighter so employed shall not be considered an active member of this
retirement system, shall not accrue any additional benefits, shall not pay
employee contributions to this retirement system, and shall not be eligible for
employment benefits, including, without limitation, life and health insurance,
by virtue of such employment. The provisions of this subsection shall not
become a part of any employment contract and shall be subject to future
legislation. Any firefighter subject to this subsection may elect at any time
to suspend his or her retirement benefits and become a regular full_time
firefighter as otherwise provided in this chapter, but no service accrued under
this subsection shall under any circumstances be used to calculate a benefit
under this
chapter."
SECTION 2.
This Act shall become effective on July 1, 2004, only if it
is determined to have been concurrently funded as provided in Chapter 20 of
Title 47 of the Official Code of Georgia Annotated, the "Public Retirement
Systems Standards Law"; otherwise, this Act shall not become effective and shall
be automatically repealed in its entirety on July 1, 2004, as required by
subsection (a) of Code Section 47_20_50.
SECTION 3.
All laws and parts of laws in conflict with this Act are
repealed.
