A BILL TO BE
ENTITLED AN ACT
To amend Code Section 15-10-60 of the Official Code of
Georgia Annotated, relating to the applicability of the article on violation of
ordinances of county and state authorities and imposition of suspended
sentences, so as to provide for increased jail punishment; to provide for
related matters; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Code Section 15-10-60 of the Official Code of Georgia
Annotated, relating to the applicability of the article on violation of
ordinances of county and state authorities and imposition of suspended
sentences, is amended by striking subsection (a) and inserting in lieu thereof
the
following: "(a)
This article governs trials of violations of county ordinances and ordinances of
state authorities, which violations may be punished by incarceration or monetary
penalty. Nothing in this chapter shall grant to any county or state authority
more authority to enact or enforce such ordinances than the county or state
authority has independently of this chapter. The punishment imposed for any
ordinance violation shall not exceed a fine of $1,000.00 or 60
days' six months imprisonment or both, except as otherwise
provided by general law, and shall not exceed the maximum punishment specified
by the ordinance."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
