A RESOLUTION

Creating the Atlanta-Fulton County Local Government Restructuring Study Commission; and for other purposes.

WHEREAS, alternative forms of government and jurisdiction for the City of Atlanta and currently unincorporated Fulton County should be investigated to find means of improving the governance of these political subdivisions and clearly defining roles for each in providing effective, cost-efficient, and nonredundant government services to the residents thereof; and

WHEREAS, two alternative changes in government structures and jurisdiction for the City of Atlanta and currently unincorporated Fulton County that are worthy of particular study include:
(1) Creating a consolidated government of Atlanta-Fulton County; or
(2) Incorporating all currently unincorporated areas of Fulton County by:
(A) The creation of new municipalities in currently unincorporated areas;
(B) Annexation of currently unincorporated areas by existing municipalities other than the City of Atlanta; or
(C) Some combination thereof.

NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY that there is created the Atlanta-Fulton County Local Government Restructuring Study Commission to be composed of 20 members. The Speaker of the House of Representatives shall appoint ten members as follows: legislative members consisting of two members of the House of Representatives; one representative of the governing authority of the City of Atlanta; one representative of the governing authority of Fulton County; one representative of the Atlanta Board of Education; one representative of the Fulton County Board of Education; two representatives of local Chambers of Commerce; one representative of the Department of Public Administration and Urban Studies of the Andrew Young School of Policy Studies of Georgia State University; and one representative of the School of City and Regional Planning of the College of Architecture of the Georgia Institute of Technology. The President of the Senate likewise shall appoint ten members consisting of the same number of representatives from each of the above-named entities and locales, except that two members of the Senate shall be appointed as legislative members. The Speaker of the House of Representatives shall designate the chairperson of the commission. All members shall be appointed no later than August 1, 2004. Commission members shall serve as such without compensation.

BE IT FURTHER RESOLVED that the commission shall undertake a study of the conditions, needs, issues, problems, and alternatives described above and recommend any actions or legislation that the commission deems appropriate. The chairperson shall call all meetings of the commission. The commission may conduct meetings at such places and at such times as deemed necessary or convenient to enable it to exercise fully and effectively its powers, perform its duties, and accomplish the objectives and purposes of this resolution. The commission shall make a report of its findings and recommendations to the General Assembly with suggestions for proposed legislation, if any, no later than December 31, 2004. The commission shall stand abolished on December 31, 2004.
