A RESOLUTION

Creating the House Local School District Development Impact Fees Study Committee; and for other purposes.

WHEREAS, the Constitution provides for local revenues in support of local school systems by means of school taxes levied on the assessed value of all taxable property within the territories served by local school systems and also authorizes local sales taxes for educational purposes; and

WHEREAS, municipalities and counties in this state have been authorized by law to impose by ordinance development impact fees as a condition of development approval so as to provide an equitable program for planning and financing public facilities needed to serve new growth and development and to protect the public health, safety, and welfare; and

WHEREAS, while local school districts are significantly affected by growth and development, impact fees imposed by municipalities or counties do not contribute to the financial support of such improvements, expansions, and constructions of public schools as are necessary to serve new growth and development; and

WHEREAS, the potential imposition and use of development impact fees by local school districts to finance public schools needed to serve new growth and development is worthy of study.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that there is created the House Local School District Development Impact Fees Study Committee to be composed of five members of the House of Representatives to be appointed by the Speaker of the House of Representatives.
