A RESOLUTION
Proposing an amendment to the Constitution so as to allocate
the total revenue from the state excise tax on cigars, cigarettes, and other
tobacco products to fund the state Medicaid program; to provide for the
submission of this amendment for ratification or rejection; and for other
purposes.
BE IT RESOLVED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Article III, Section IX, Paragraph VI is amended by adding a
new subparagraph (n) at the end thereof to read as
follows: "(n)
The General Assembly shall provide by general law for the creation of a separate
medical assistance trust fund. The total amount of revenue derived from the
state excise tax on cigars, cigarettes, and tobacco products shall be paid into
such trust fund to fund the state Medicaid program. Moneys paid into the trust
fund shall not be subject to the provisions of Article III, Section IX,
Paragraph IV(c), relative to lapsing of funds, or of Article VII, Section III,
Paragraph II, relative to funds paid into the state treasury, except that moneys
appropriated from the trust fund and not committed shall lapse back to the trust
fund."
SECTION 2.
The above proposed amendment to the Constitution shall be
published and submitted as provided in Article X, Section I, Paragraph II of the
Constitution. The ballot submitting the above proposed amendment shall have
written or printed thereon the following:

( ) NO

Shall the Constitution be amended so as to allocate the
total revenue from the levy of the state excise tax on cigar, cigarette, and
tobacco products to fund the state Medicaid program?"

All persons desiring to vote in favor of ratifying the
proposed amendment shall vote "Yes." All persons desiring to vote against
ratifying the proposed amendment shall vote "No." If such amendment shall be
ratified as provided in said Paragraph of the Constitution, it shall become a
part of the Constitution of this state.
