House Resolution
399 By: Representatives Lucas of the 105th,
Rogers of the 20th, Skipper of the 116th, Wix of the
33rd, Post 1, Burkhalter of the 36th, and others
A RESOLUTION
Urging the Federal Energy Regulatory Commission not to adopt
its proposed rules for standard market design of electricity markets; urging
Congress to take such steps as are necessary to assure that the Federal Energy
Regulatory Commission not adopt its proposed rules for standard market design;
and for other purposes.
WHEREAS, on July 31, 2002,
the Federal Energy Regulatory Commission issued a Notice of Proposed Rulemaking
proposing a standard market design for the operation of all electric
transmission systems on a regional basis by an operator independent of the
electric utilities; and
WHEREAS, the adoption of
the standard market design could cause the costs of electricity to rise in
Georgia while jeopardizing the reliability of the systems our citizens enjoy;
and
WHEREAS, the cost of electric service to
Georgians is far below the national average;
and
WHEREAS,
Georgia´s
electric system is among the most reliable in the nation; and
WHEREAS,
Georgia´s
electric transmission system has no major transmission bottlenecks which impair
reliability or increase costs for retail customers in our state or other states
in the region; and
WHEREAS,
Georgia´s
integrated electric system, owned and operated by investor owned utilities,
electric membership corporations, and municipal systems is technically and
financially sound and has provided the infrastructure and planning needed to
serve the people in our state now and for the future; and
WHEREAS, a cost benefit study authorized by the
Southeastern Association of Regulatory Utility Commissioners, including our
Georgia Public Service Commission, indicated that Georgia and other southeastern
states would be paying more under standard market design as proposed by the
Federal Energy Regulatory Commission; and
WHEREAS,
the adoption of standard market design would likely result in a dispute between
the state of Georgia and the Federal Energy Regulatory Commission over the
jurisdiction of the state to regulate the rates, terms, and conditions of retail
electric service provided to the citizens of
Georgia.
NOW, THEREFORE, BE IT RESOLVED BY THE
HOUSE OF REPRESENTATIVES that the Federal Energy Regulatory Commission is urged
not to adopt its proposed rules for standard market design for electricity
markets; and
BE IT FURTHER RESOLVED that the
Congress of the United States of America is urged to review and consider the
position of the State of Georgia on this issue and take such action as is
necessary to assure that the Federal Energy Regulatory Commission not adopt its
proposed rules for standard market design;
BE IT
FURTHER RESOLVED that the Clerk of the House of Representatives is authorized
and directed to transmit copies of this resolution to the Honorable Pat Wood,
chairman, and the Honorable William L. Massey and the Honorable Nora Mead
Brownell, commissioners of the Federal Energy Regulatory Commission; the
President of the United States; the Speaker of the United States House of
Representatives; the President Pro Tempore of the United States Senate; the
chairman of the United States Senate Energy Committee; the chairman of the
United States House of Representatives Commerce Committee; the Georgia
congressional delegation; and the Commissioners of the Georgia Public Service
Commission.
