A BILL TO BE
ENTITLED AN ACT
To amend Chapter 2 of Title 46 of the Official Code of
Georgia Annotated, relating to the Public Service Commission, so as to authorize
the commission to establish administrative fees for certain applications and
proceedings; to provide that such fees shall be in an amount reasonably
necessary to cover the costs of the commission; to provide for the disposition
of such fees; to repeal conflicting laws; and for other
purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
GEORGIA:
SECTION 1.
Chapter 2 of Title 46 of the Official Code of Georgia
Annotated, relating to the Public Service Commission, is amended by inserting a
new Code section at the end of Article 1 to be designated Code Section 46-2-11,
to read as
follows: "46-2-11. The
commission is authorized to establish, by rule, schedule, or order,
administrative fees for applications and proceedings
including: (1) Rate-making proceedings under Code
Sections 46-2-20, 46-2-23, and 46-2-25; (2) Fuel cost
recovery proceedings under Code Section 46-2-26; (3)
Gas supply plan proceedings under Code Section
46-2-26.5; (4) Applications to resolve territorial
disputes under Code Section 46-3-1; (5) Capacity supply
plan proceedings under subsection (e) of Code Section
46-4-155; (6) Applications for arbitration of terms and
conditions of interconnection under Code Section
46-5-1; (7) Applications for financing
authority; (8) Applications for certificates of
authority and for certificates of public convenience and necessity;
and (9) Other proceedings as determined by the
commission by rule. Fee amounts established by the
commission under this Code section shall be in an amount reasonably necessary to
cover the costs of the commission in reviewing the application or the filings in
the proceeding and determining the disposition of the application or the
proceeding, including, but not limited to, the expense of conducting any
hearings or other proceedings required to accomplish the purposes of the Code
sections relating to such application or proceeding. All fees recovered by the
commission shall be paid into the general fund of the state
treasury."
SECTION 2.
All laws and parts of laws in conflict with this Act are
repealed.
